Agreement to Terms

These Terms of Service ("Terms") govern your use of the Bill Nest AI mobile application and services provided by Bill Nest AI, Inc. ("we," "us," or "our"). By downloading, installing, or using our app, you agree to be bound by these Terms.

1. Description of Service

Bill Nest AI provides a family-focused financial management application that allows users to:

  • Manually track expenses and income
  • Scan and process receipts using AI
  • Create and manage mock financial accounts
  • Set up bill reminders and tracking
  • Manage family member allowances
  • Participate in automated savings challenges
  • Access AI-powered financial insights
  • Customize financial dashboards

2. User Accounts and Registration

Account Creation

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You may not share your account with others

Family Members

  • Family owners are responsible for all family member activities
  • Children under 18 must have parental permission to use the app
  • Family owners can manage permissions and access for all members

3. Acceptable Use Policy

You May:

  • Use the app for personal and family financial management
  • Input accurate financial information for tracking purposes
  • Share the app with immediate family members
  • Contact support for assistance and feedback

You May Not:

  • Use the app for any illegal or unauthorized purpose
  • Attempt to reverse engineer or copy our software
  • Upload malicious content or attempt to hack our systems
  • Use the app for commercial purposes without permission
  • Create false accounts or impersonate others
  • Violate any applicable laws or regulations

4. Subscription and Payment Terms

Free and Pro Plans

We offer both free and paid subscription plans. Pro subscription features and pricing are clearly displayed in the app and on our website.

Payment Processing

  • Payments are processed through Apple App Store or Google Play Store
  • Subscriptions automatically renew unless cancelled
  • Refunds are subject to App Store and Google Play policies
  • We may change pricing with 30 days notice

Cancellation

You can cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period.

5. Data and Privacy

Your Data Ownership

  • You retain ownership of all data you input into the app
  • We do not access or connect to your bank accounts
  • All financial data is manually entered by you or your family
  • We use data only as described in our Privacy Policy

6. AI and Machine Learning Features

Our AI features include receipt scanning, financial insights, and automated challenges. Please note:

  • AI results are for informational purposes and may contain errors
  • You should review all AI-processed information for accuracy

  • We continuously improve AI accuracy but cannot guarantee perfection

7. Intellectual Property Rights

Our Rights

The Bill Nest AI app, including its design, features, text, graphics, and software, is owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Rights

We grant you a limited, non-exclusive, non-transferable license to use the app for personal and family financial management purposes in accordance with these Terms.

8. Disclaimers and Limitations

Service Availability

  • We strive for 99.9% uptime but cannot guarantee uninterrupted service
  • We may temporarily suspend service for maintenance or updates
  • We are not liable for service interruptions or data loss

Accuracy Disclaimer

While we strive for accuracy in our AI features and calculations, you are responsible for verifying all financial information and results. We recommend regularly reviewing and backing up your data.

9. Limitation of Liability

To the maximum extent permitted by law, Bill Nest AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

10. Termination

By You

You may terminate your account at any time by deleting the app and cancelling any active subscriptions through the App Store or Google Play.

By Us

We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or for other legitimate business reasons. We will provide reasonable notice when possible.

11. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Tennessee.

12. iOS App Store EULA Addendum

The following terms apply specifically when you access or use the Bill Nest AI application obtained through the Apple App Store. These terms supplement, and do not replace, the other provisions of these Terms of Service.

  1. Acknowledgement: You and Bill Nest AI acknowledge that these Terms are concluded between Bill Nest AI and you only, and not with Apple, Inc. ("Apple"), and that Bill Nest AI, not Apple, is solely responsible for the Licensed Application and the content thereof.
  2. Scope of License: The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (the "Usage Rules").
  3. Maintenance and Support: Bill Nest AI is solely responsible for providing any maintenance and support services for the Licensed Application as required under applicable law. You and Bill Nest AI acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
  4. Warranty: Bill Nest AI is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application.
  5. Product Claims: You and Bill Nest AI acknowledge that Bill Nest AI, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual Property Rights: You and Bill Nest AI acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party’s intellectual property rights, Bill Nest AI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
  7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer Name and Address: Any questions, complaints, or claims with respect to the Licensed Application should be directed to Bill Nest AI using the contact information provided in Section 13.
  9. Third Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the Licensed Application (e.g., your wireless data service agreement).
  10. Third Party Beneficiary: You and Bill Nest AI acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms with respect to your license of the Licensed Application, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the app or email at least 30 days before the changes take effect. Continued use of the app after changes constitutes acceptance of the new Terms.
